THISTLE GOLF LTD

TERMS OF SERVICE

Last updated: 21 October 2026

These Terms of Service apply to your use of the Thistle Golf website and to purchases made through our online store.

Please read these Terms carefully before using our website or placing an order.

By using our website or placing an order, you agree to these Terms. If you do not agree to them, please do not use our website.

These Terms should be read alongside our Privacy Policy and Returns & Refunds Policy.

1. ABOUT US

Thistle Golf is a trading name of Thistle Golf Ltd, a company registered in Scotland.

Company number: SC869616
Registered office: 22 Farnell Way, Dunfermline, United Kingdom, KY12 0SR
Email: Jack@thistlegolf.uk

In these Terms, “Thistle Golf”, “we”, “us” and “our” refer to Thistle Golf Ltd.

“Customer”, “you” and “your” refer to the person using our website or purchasing our products.

2. USING OUR WEBSITE

You may use our website for lawful purposes only.

You must not use our website to:

  • commit or encourage any unlawful activity;

  • infringe our intellectual property rights or the rights of others;

  • introduce viruses, malicious code or other harmful material;

  • attempt to gain unauthorised access to our website or systems; or

  • interfere with the normal operation of our website.

We reserve the right to restrict or suspend access to our website where we reasonably believe these Terms have been breached.

3. OUR PRODUCTS

We make every effort to ensure that product descriptions, photographs, colours and measurements on our website are accurate.

However, many Thistle Golf products are handmade using genuine tartans, kilts, plaids, leather and other existing materials. As a result, individual products may vary slightly in colour, texture, pattern placement and appearance.

These natural variations are part of the character of our products and do not constitute a defect.

We will not, however, use this provision to exclude your statutory rights where a product is faulty, not as described or otherwise does not comply with applicable consumer law.

We reserve the right to make reasonable changes to products where necessary, provided that any such change does not materially affect the product purchased.

4. ORDERS

When you place an order through our website, you are making an offer to purchase the products in your order.

After placing an order, you will receive an order confirmation acknowledging that we have received your order. This does not necessarily mean that your order has been accepted.

A contract between you and us will be formed when we confirm that your order has been accepted and is being processed.

We reserve the right to refuse or cancel an order where, for example:

  • a product is unavailable;

  • there has been an obvious pricing or product description error;

  • we reasonably believe an order has been placed fraudulently; or

  • we are unable to fulfil the order for reasons outside our reasonable control.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order.

5. PRICES

All prices displayed on our website are in pounds sterling (£).

The price payable will be the price displayed at the time you place your order, unless there has been an obvious pricing error.

Where applicable, VAT will be charged at the rate required by law.

Delivery charges will be shown separately at checkout where applicable.

We may change our prices from time to time, but changes will not affect orders that we have already accepted.

6. PAYMENT

Payment must be made using one of the payment methods available at checkout.

You confirm that you are authorised to use the payment method provided.

Payment information is processed through our payment providers and we do not normally have access to your full payment card details.

7. DELIVERY

We will provide an estimated delivery timeframe for your order where possible.

Delivery times are estimates and may be affected by circumstances outside our reasonable control, including carrier delays, customs delays or other unforeseen events.

Unless otherwise agreed with you, goods will be delivered within the period required by applicable law.

If an order is delayed significantly or is not delivered within the legally applicable timeframe, you may have rights to cancel the contract and receive a refund.

For international orders, the customer may be responsible for any applicable customs duties, import taxes or other charges imposed by the destination country.

8. RETURNS AND YOUR RIGHT TO CANCEL

If you purchase a standard, non-personalised product online, you generally have a legal right to cancel your order within 14 days of receiving the goods without giving a reason.

If you choose to cancel, you must tell us clearly that you wish to cancel and return the goods within the applicable period set out in our Returns & Refunds Policy.

Unless otherwise required by law, you are responsible for the direct cost of returning goods when exercising your change-of-mind cancellation right.

Goods should be returned in an appropriate condition and with their original packaging where reasonably possible.

You may handle goods only to the extent reasonably necessary to establish their nature, characteristics and functioning. We may be entitled to deduct an amount from your refund where goods have been handled beyond this and their value has consequently been reduced.

Refunds will be made in accordance with applicable law and our Returns & Refunds Policy.

9. CUSTOM AND PERSONALISED PRODUCTS

Some Thistle Golf products are made specifically for an individual customer and may include:

  • Personalised embroidery;

  • Initials, names or other personalisation;

  • Bespoke tartans or materials;

  • Customer-supplied materials;

  • Bespoke design requests; or

  • Other changes made specifically to the customer's requirements.

Where a product is genuinely made to your specification or clearly personalised, your statutory 14-day change-of-mind cancellation right may not apply.

Before beginning a bespoke order, we may confirm the agreed design, materials, personalisation and price with you.

This does not affect your statutory rights if a bespoke product is faulty, not as described or otherwise does not comply with applicable consumer law.

10. CUSTOMER-SUPPLIED MATERIALS

Where you ask us to make a product using material supplied by you, you confirm that:

  • You own the material or have permission to provide it to us;

  • You have the right to authorise us to use the material for the agreed purpose; and

  • The material does not knowingly infringe another person's rights.

We will take reasonable care of customer-supplied materials while they are in our possession.

However, materials such as old kilts, tartans, clothing and other previously used fabrics may already have signs of wear, weakness, fading, staining or other imperfections.

We cannot guarantee that every material supplied by a customer will be suitable for use.

If we reasonably believe that supplied material is unsuitable, unsafe or unlikely to produce an acceptable finished product, we may contact you before proceeding.

Where appropriate, we may recommend an alternative material or design.

11. FAULTY OR INCORRECT PRODUCTS

Your statutory rights are not affected by these Terms.

If a product is faulty, damaged, not as described or otherwise does not comply with your legal rights, please contact us as soon as reasonably possible.

We may ask for photographs or other information to help us understand the issue.

Depending on the circumstances and your legal rights, we may offer a repair, replacement, refund or another appropriate remedy.

Nothing in these Terms limits or excludes any liability or legal right that cannot lawfully be limited or excluded.

12. HANDMADE PRODUCTS

Our products are handmade and some of our products may contain genuine recycled, reclaimed or previously used materials.

Where a product description states that a material is reclaimed, recycled, vintage or previously used, characteristics associated with that material may include variations in colour, texture, stitching, wear or pattern.

These characteristics are part of the product and are not necessarily defects.

13. INTELLECTUAL PROPERTY

All content on this website, including our branding, logos, photographs, product designs, text, graphics and other materials, belongs to Thistle Golf Ltd or is used by us with permission.

You may view and use the website for your personal, non-commercial purposes.

You must not reproduce, copy, modify, distribute, sell or commercially exploit our website content, product designs, photographs, branding or other intellectual property without our prior written permission.

The name “Thistle Golf”, our logos, designs and associated branding may not be used without our permission.

14. THIRD-PARTY WEBSITES AND SERVICES

Our website may contain links to third-party websites or use third-party services, including payment, delivery, analytics and other providers.

We are not responsible for the content, security, availability or practices of third-party websites that we do not operate.

Your use of third-party services may also be subject to the terms and policies of those third parties.

15. SHOPIFY

Our online store is hosted and operated using Shopify's platform.

Purchases made through our website are contracts between you and Thistle Golf Ltd. Shopify provides the technology and services that enable us to operate our online store but is not the seller of our products.

16. REVIEWS AND CUSTOMER CONTENT

If you submit a review, photograph, testimonial or other content to us, you confirm that you have the right to provide that content to us.

By submitting content to us, you give Thistle Golf permission to use, reproduce and display that content for the purposes of operating and promoting Thistle Golf, including on our website and social media channels.

We may choose not to publish or may remove content that we reasonably consider inappropriate, unlawful, misleading or unrelated to Thistle Golf.

We will not claim ownership of your underlying content simply because you have submitted it to us.

17. WEBSITE AVAILABILITY AND INFORMATION

We aim to keep our website accurate and available, but we do not guarantee that it will always be available, uninterrupted or free from errors.

We may update, suspend or withdraw parts of the website from time to time.

We may correct typographical errors, pricing errors or other inaccuracies where they occur.

18. OUR LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

This includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Subject to the above, we are not responsible for losses that are not reasonably foreseeable or that are not caused by our breach of these Terms.

Nothing in these Terms affects your statutory rights as a consumer.

19. EVENTS OUTSIDE OUR CONTROL

We will not be responsible for failure or delay in performing our obligations where this is caused by circumstances outside our reasonable control.

This may include, for example, serious disruption to postal or delivery services, natural disasters, fire, major supplier disruption, government restrictions, industrial disputes or other events that could not reasonably have been anticipated or prevented.

Where such an event affects your order, we will take reasonable steps to contact you and minimise the impact.

20. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The version of the Terms that applies to an order will generally be the version in force when you place that order, unless we are required to make a change by law.

The latest version will always be available on this page.

21. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed to the extent necessary, without affecting the validity of the remaining provisions.

22. GOVERNING LAW

These Terms and any contract between you and Thistle Golf Ltd are governed by the law of Scotland.

Any disputes will be subject to the jurisdiction of the Scottish courts, except where mandatory consumer protection law gives you the right to bring proceedings elsewhere.
